1. SELLER’S COMMERCIAL POLICY

1.1 The Seller offers for sale the products available on the website Arrières Mondes (hereinafter "the Site") and conducts its online sales exclusively to customers who purchase the products for personal purposes as final consumers (hereinafter referred to as "Buyers"), thus excluding any reseller or intermediary acting on behalf of resellers.

1.2 Only Buyers who have reached the legal age of majority and have full legal capacity to commit under these T&Cs are entitled to access the online sales service offered by the Seller. Therefore, any person not meeting these criteria is invited to refrain from placing any orders on the Site.

1.3 The Seller’s online sales service is only available for the following countries (France, Belgium, Germany, Sweden, Netherlands, Spain and Italy). Buyers not residing in these countries are free to place orders, but they must select delivery only within the available regions where the service is offered.

1.4 In accordance with its commercial policy, the Seller reserves the right not to process any orders that: (i) do not comply with the criteria described in sections 1.1, 1.2, or 1.3; (ii) do not align with the Seller’s commercial policy; (iii) are deemed abnormal in terms of quantity (e.g., orders exceeding 5 pieces of the same product); or (iv) are suspected of being fraudulent, illegal, or unauthorized, including suspected purchases for commercial purposes.

1.5 These T&Cs apply exclusively to any contract governing the online sale of products by the Seller to the Buyer through the Site (hereinafter the "Contract").

1.6 Before placing an order, Buyers must agree to the following documents: (i) these T&Cs, (ii) the Site’s Terms of Use, (iii) the Seller’s Privacy Policy, and (iv) the withdrawal and return policy.

2. CONCLUSION OF THE CONTRACT WITH THE SELLER

2.1 To conclude a contract with the Seller, the Buyer must: (i) select the desired products, (ii) complete the order form with the required personal information, (iii) select the delivery method, and (iv) choose a payment method.

2.2 Before confirming the order, the Buyer will be provided with a summary including: (i) the essential characteristics and price of each product, (ii) the total price of the order, (iii) the selected payment method, (iv) the chosen delivery method and estimated delivery date, (v) shipping fees, and (vi) the withdrawal policy.

2.3 By placing an order, the Buyer makes a firm offer to purchase the selected products, subject to these T&Cs, and agrees to pay for them.

2.4 Orders will be recorded in the Seller’s database for processing, and the Seller will acknowledge receipt of the order by email. This acknowledgment does not constitute acceptance of the order. The Seller reserves the right to refuse the order if it does not meet the terms outlined.

2.5 The contract between the Buyer and the Seller is deemed concluded when the Buyer receives an order confirmation email from the Seller.

2.6 The order confirmation will include the order number, essential product information, and shipping details.

3. PRODUCT DESCRIPTION AND PRICING

3.1 The Seller guarantees the authenticity of the products sold on the Site.

3.2 Products sold are not second-hand or defective. Essential information and characteristics of the products are available in the "Product Details" section of the Site.

3.3 Prices are displayed in euros, including VAT. Shipping fees are added at the time of order confirmation and may vary based on delivery methods and locations.

3.4 The Seller reserves the right to modify prices at any time, but price changes do not affect orders that have already been confirmed.

4. PAYMENT

4.1 The Buyer must pay for the products and any applicable shipping fees as outlined in the order confirmation. Payments are processed through Stripe, PayPal, or Apple Pay.

4.2 Payment is encrypted, and the Seller will not have access to the Buyer’s financial information, which is processed securely by third-party payment providers.

4.3 The amount will be debited after the order confirmation and upon receipt of payment authorization.

4.4 In case of a payment issue, the order will be canceled, and the contract terminated without liability for the Seller.

5. SHIPPING AND DELIVERY

5.1  Shipping costs are not included in the product price and are listed separately during checkout.

5.2 Ownership of the products and the risk of loss or damage pass to the Buyer upon delivery.

7. WITHDRAWAL RIGHT

7.1 In accordance with Article L.221-18 of the French Consumer Code, the Buyer has 14 days to withdraw from the contract without providing any reason.

7.2 Products must be returned in their original condition and packaging within 14 days.

7.3 The Buyer will be refunded the total amount paid, excluding any additional shipping fees for express delivery.

8. WARRANTY

8.1 The products sold by the Seller are subject to the legal warranties of conformity and against hidden defects, as per Articles L.217-4 and L.217-5 of the French Consumer Code.

8.2 In the event of a defect, the Buyer may choose between repair or replacement of the product, unless this is disproportionate to the cost for the Seller.

9. APPLICABLE LAW AND DISPUTES

9.1 These T&Cs are governed by French law.

9.2 In case of a dispute, the Buyer can contact the Seller to resolve the issue amicably or contact the designated consumer mediator.

9.3 If no agreement can be reached, the Buyer has the option to seek mediation, free of charge, from the designated consumer mediator:

9.4 The Buyer can also file a complaint through the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

9.5 Any dispute relating to the interpretation or application of these Terms and Conditions shall be submitted to the competent courts of France.
